The Transparency Program of
The National Authority for Electronic Certification
and Cyber Security
I. INTRODUCTION
In accordance with session 7 of the Law No.119 / 2014 "On the right to information", the transparency program is prepared for the National Authority for Electronic Certification and Cyber Security. This program sets out the legal framework for the activity of the authority within the law no.119 / 2014 "On the right to information" (LDI).
This program is evaluated as a concrete way through which the Public Authority (AKCESK) builds and enhances transparency in its institutional work, under the guarantee of the LDI. AKCESK will periodically update the Transparency Program, in accordance with point 2 in the session 5 of the LDI.
The information made public in this program, aims to do the transparency of AKCESK's work activity through its detailed coverage on the official website www.akce.gov.al as well as on the environments of the institution. The transparency program is reflected in the sections, texts / contents, time limits for making it public, the manner of making it public and the propriate structure that produces or manages the document.
In the content of the transparency program, a publication scheme is highlighted, which reflects the menus where the document is addressed on the official website. In addition, each document is also accessible in the scheme.
The documentation made public will be updated in form and content. AKCESK's official website is built in a form that provides information to the public without a request in an easily understandable forms. In the sections of the official site are also reflected informations that are characterized by the limitations of the personal data identification due to the privacy of individuals / data subjects etc.

II. GENERAL PRINCIPLES
The main principles where the AKCESK's Transparency Program is supported:
1. “The right to inform "is the constitutional right provided in the session 23 of it, accessible to all without exception.
2. The presumption of the maximal publication of data: AKCESK exercises public functions, consequently the information deriving from its activity is published in accordance with the legislation in force.
3. Correct implementation of the law and legal provisions that regulate AKCESK activity in a particular way: Law no. 9880/2008 "For electronic signatures" (updated) and Law 119/2014 "On the right to information".
4. The information fits in a clear and understandable language.
5. The oversight procedures organism of the public information is the Commissioner for the Right to Information and Protection of the Personal Data "( KDIMDP).
6. The review of the transparency program is made according to the same procedure, through which its appruval has been made.
The public information without request should be:
-complete;
-correct;
-updated;
-easy in consultation;
-understandable;
-easily accessible;
-compatible with the original documents in the possession of the public authority.
III. THE INFORMATION MADE PUBLIC WITHOUT REQUEST
The information allowed for publication is expressly predicted in session 7 of the Law No.119 / 2014 "Për të Drejtën e Informimit". The information permitted for publication is expressly predicted in session 7 of the Law No.119 / 2014 "Për të Drejtën e Informimit ".
In accordance with this approved transparency program, AKCESK makes available to the public on its website www.akce.gov.al and at the environment of the institution the following categories of information: The organizational structure of AKCE;
Full texts of conventions that have been ratified, of laws,of reguations, codes of conduct, policy documents, manuals or any other document related to the exercise of its functions and affecting the general public;
Information on the procedures that should be followed to make a request for information, postal and electronic address for filing information requests, as well as the appeal procedures for the respective decision;
Information about the location of public authority offices, working hours, name and the contact of the coordinator for the right to inform; ;
Data on education, qualifications and salaries of functionaries who have the obligation to declare the property according to law, salaries structures for other employees, as well as a description of the selection procedures, competences and duties of high public officials and the procedure they pursue to make decisions;
Monitoring and control mechanisms operating on public authority, including strategic work plans, audit reports from the Supreme State Audit or other entities, as well as documents containing performance indicators of the authority;
Data on the budget and expenditure plan for the following financial year and past years, as well as any annual report on budget implementation.In those cases where the public authority is self-financed by license fees or any other form of direct funding from the entities regulated by it, the documents showing the status of repayment of liabilities by licensed entities become public;
Information on procurement procedures or competitive concession / public private partnership procedures, respectively, according to the provisions of law no. 9643, dated 20.12.2006, "w On Public Procurement", and Law no. 125/2013, "ON Concessions and Public Private Partnership", carried out on behalf of the public authority, including: the list of related contracts, the contracted amount, the contracting parties and the description of the contracted services or goods, the information on the implementation and monitoring of contracts, as well as various policies and guidelines;
Information on the services that the authority gives to the public, including quality service CIIs Operators, a description of categories and forms of social assistance, subsidies given by the public authority and procedures to obtain them, information and documents that are often required and any other information deemed useful by the public authority;
Any mechanism and procedure for making claims and complaints regarding the actions or omissions of public authority, procedure, through which interested persons may present their opinions or influence in any other way in drafting laws, public policies or exercising the functions of AKCESK, a simple description of the system used by the public authority to maintain documentation, types, forms of documents, and categories of information that is made public without a requirement;
AKCE also creates and archives a digital copy of its official web site, supplemented with the information required in the program to Collaborate and coordinate with other institutions, for the Implementation of electronic signature, electronic identification and trusted services for citizens,as well as the methods, mechanisms and periodicity of the publication of public information, which are made available to the public without a requirement;
Acts containing rules, norms or limitations of the individual's fundamental rights and freedoms and with direct effect to them are made public by posting on paper or posting on the official website within 48 hours of the adoption of the act by the AKCE.Information published under this scheme is updated each time it changes.

V. PUBLICATION
In accordance with this approved transparency program, AKCESK makes available to the public on its website www.akce.gov.al and in the public waiting areas, the above categories, in a special menu titled “Transparency Program”.
VI. MONITORING
The Commissioner for the Right to Information and Protection of Personal Data monitors the implementation of the law on the right to information, promoting the principle of transparency in the work of public authorities, particularly by sensitizing and informing on issues of the right to information.
The Commissioner makes recommendations to public authorities regarding the conceptualization and implementation of institutional transparency programs.
